Blood Alcohol Count

In Pennsylvania, there are three levels of DUI based on blood alcohol content level, with mandatory minimum sanctions for each. First through fourth offenses on each level also have escalating penalties in terms of fines, jail time and length of driver’s license suspension. First Time DUI Offense

On a first offense DUI, we can work toward diversion of your case into the Pennsylvania ARD program. Accelerated Rehabilitative Disposition gives you a shorter suspension, and if you can maintain a clean driving record for a year, the charge of drunk driving will be dismissed.

Repeat DUI Offenders and Felony Charges

For more serious DUI charges and repeat offenders, a more intensive defense based on blood alcohol forensics might be necessary, unless we can suppress the evidence of drunk driving on the basis of an improper traffic stop, lack of probable cause to make the arrest or other constitutional issues.
